Please read these Terms of Service and Terms of Sale (collectively, "Terms") carefully before using the Kindred Fine website at kindredfine.com (the "Site") or purchasing any products. These Terms constitute a legally binding agreement between you and Kindred Fine LLC, a company registered in New York, "Kindred Fine, " "we, " "us, " or "our"). By accessing or using our Site, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site or place an order.

1. Acceptance of Terms

Your access to and use of the Site is conditioned on your acceptance of and compliance withthese Terms. These Terms apply to all visitors, users, and customers of the Site. We reserve the right to update or modify these Terms at any time, with changes effective upon posting to the Site. Your continued use of the Site following any changes constitutes your acceptance of the revised Terms.

2. Eligibility

By using our Site or placing an order, you represent and warrant that:

  • You are at least 18 years of age (or the age of majority in your jurisdiction)

  • You are legally capable of entering into a binding contract

  • You are not prohibited from purchasing our products under applicable laws

Our products are intended for personal, non-commercial use. We reserve the right to refuse service to anyone for any reason.

3. Account Registration

You may choose to create an account on our Site. You are responsible for:

  • Maintaining the confidentiality of your account credentials

  • All activity that occurs under your account

  • Ensuring that your account information is accurate and kept up to date

Please notify us immediately at hello@kindredfine.com if you suspect unauthorized use of your account. We reserve the right to terminate accounts at our discretion.

4. Products and Pricing

Product Descriptions

We strive to accurately describe all products on our Site, including descriptions, dimensions, materials, and photography. However:

  • Colors: Product images are intended to be as accurate as possible, but we cannot guarantee that your device's display will accurately reflect the true color of an item. Slight variations in color from product photography are normal and not considered defects.

  • Enamel variation: All enamel on Kindred Fine jewelry is hand-finished by skilled artisans. Each piece is therefore unique, and slight variations in color, texture, or placement of enamel from the product photographs — or between individual pieces — are a natural result of the handmade process and are not considered defects. These variations are what give each piece its individual character.

  • Pearl variation: Freshwater pearls are natural and may vary in shape, size, luster, and surface texture. These variations are characteristic of genuine pearls and are not considered flaws.

  • Carat weights: Any stated carat weights for gemstones are approximate estimates and may vary within industry-standard tolerances (typically ± 10%).

  • Measurements: All measurements (chain lengths, charm dimensions) are approximate.

We reserve the right to correct any typographical errors, inaccuracies, or omissions in product descriptions or pricing at any time, even after an order has been submitted, and to cancel any orders that were placed based on incorrect information (with a full refund issued to you).

Pricing

All prices are displayed in US Dollars (USD) and are subject to change without notice. The price charged for your order will be the price displayed at the time you place your order, provided your order is accepted. We reserve the right to modify prices at any time Prices do not include applicable sales tax, which is calculated and added at checkout based on your shipping address.

5. Order Acceptance and Cancellation

Placing an order on our Site constitutes an offer to purchase. A contract of sale is not formed until we accept your order. We accept your order when we send you a shipping confirmation email.

We reserve the right, in our sole discretion, to:

  • Refuse or cancel any order for any reason, including but not limited to product unavailability, suspected fraud, pricing errors, or suspected resale

  • Limit the quantity of products available for purchase per person, per household, or per order

  • Decline orders from distributors, resellers, or third-party retailers

If we cancel or refuse your order after payment has been received, we will issue a full refund to your original payment method.

You may cancel an in-stock order by contacting us at hello@kindredfine.com within 24 hours of placing it. Once production has begun on a made-to-order or custom piece, cancellation may not be possible.

6. Payment Terms

We accept the following payment methods:

  • Major credit and debit cards: Visa, Mastercard, American Express, Discover

  • Apple Pay

  • Shop Pay

  • PayPal

  • Klarna (installment payment plans, subject to Klarna's approval and terms)

  • Afterpay (installment payment plans, subject to Afterpay's approval and terms)

Full payment is required at the time of purchase before any order is processed or production begins. By providing your payment information, you represent that you are authorized to use the payment method and authorize us to charge the total amount (including applicable taxes and shipping).

All credit card transactions are encrypted during transmission. We do not store your full credit card details on our servers.

If payment is declined or cannot be verified, we reserve the right to cancel or put your order on hold. We will contact you using the information provided at checkout.

7 . Shipping and Delivery

Shipping terms, costs, processing times, and carrier information are set out in detail in our Shipping & Returns policy. Key terms:

  • Risk of loss transfers to you upon delivery of the package to the carrier (FedEx, UPS, or DHL). Once your tracking number shows "delivered, " responsibility passes to you.

  • Signature requirement: A signature is required for orders over $500. If a package is undelivered due to no signature being available and is subsequently lost, Kindred Fine is not responsible.

  • We are not responsible for delays due to carrier issues, weather events, customs processing, or other circumstances beyond our control.

  • We do not ship to P .O. Boxes or APO/FPO addresses.

  • We are not responsible for packages sent to an incorrect address provided by the customer. Re-shipping fees in this situation are the customer's responsibility.

8. Returns and Refunds

Our return and refund policy is set out in full in our Shipping & Returns policy. Key terms:

  • Returns are accepted within 14 days of delivery on eligible, unworn, unaltered items in original condition and packaging.

  • Custom, personalized, engraved, and made-to-order pieces are final sale.

  • International orders are final sale.

  • Refunds are issued to the original payment method. Original shipping charges are non-refundable.

9. Custom and Personalized Orders

Custom, personalized, and engraved pieces are made specifically for you and are therefore:

  • Final sale — they cannot be returned, exchanged, or cancelled once production has begun

  • Require full payment in advance

  • Subject to longer lead times as communicated at the time of order

  • Subject to slight natural variation inherent in the handmade and hand-enameled process

By placing a custom order, you acknowledge and agree to these terms.

10. Jewelry-Specific Disclaimers

Natural material variation: Our hand-finished enamel is a handcrafted material. Colors may vary slightly between batches and from product photography. Slight irregularities in enamel application are inherent to the artisanal process and are not considered defects. Freshwater pearls are natural and may vary in shape, size, luster, and surface texture — these variations are characteristic of genuine pearls and are not considered flaws.

  • Gemstones: Any gemstones in our pieces are natural. Natural gemstones contain inclusions and color variations that are characteristic of the material and not considered flaws unless they significantly affect the integrity of the stone.

  • Carat weight: Any carat weights listed are approximate and may vary within ± 10% of the stated weight.

  • Product photography: We make every effort to photograph pieces accurately, but colors may appear differently across screens and under varying lighting conditions. The actual piece may vary slightly from the images shown.

  • Sizing: All measurements (chain lengths, charm dimensions, bracelet lengths) are approximate. Please refer to our FAQ for sizing guidance.

11. Intellectual Property

All content on the Kindred Fine Site — including but not limited to text, photography, product images, designs, illustrations, logos, trademarks, brand names, and the overall look and feel of the Site — is the property of Kindred Fine LLC or its licensors and is protected by United States and international copyright, trademark, and intellectual property laws.

You may view, download, and print content from the Site solely for your own personal, non-commercial use, provided you do not modify the content or remove any copyright, trademark, or other proprietary notices.

You may not reproduce, distribute, publicly display, create derivative works from, or otherwise use any content from our Site without our prior written permission.

The Kindred Fine name, logo, and all related product names and slogans are trademarks of Kindred Fine. Nothing in these Terms grants you any license or right to use our trademarks without our prior written consent.

12. User-Generated Content

If you submit, post, or share content with us — including reviews, photos, social media posts tagging our brand, or any other content (collectively, "User Content") — you grant Kindred Fine a non-exclusive, irrevocable, perpetual, worldwide, royalty-free license to use, reproduce, display, distribute, adapt, and publish that User Content in any media, for any lawful purpose, including marketing and promotional use, without compensation or attribution to you, unless required by law.

By submitting User Content, you represent and warrant that:

  • You own the content or have all necessary rights to grant us this license

  • The content does not infringe any third-party intellectual property, privacy, or other rights

  • The content is not unlawful, defamatory, offensive, or harmful

We reserve the right to remove or refuse any User Content at our discretion.

13. Prohibited Uses

You agree not to use our Site or services:

  • For any unlawful purpose or in violation of any applicable laws or regulations

  • To transmit any harmful, offensive, fraudulent, or deceptive content

  • To impersonate any person or entity or misrepresent your affiliation with any person or entity

  • To collect or harvest any personal information from other users

  • To interfere with or disrupt the integrity or performance of the Site

  • To attempt to gain unauthorized access to any portion of the Site or its related systems

  • For commercial purposes (resale, distribution) without our written consent

14. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS AND SERVICES OFFERED THROUGH IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH OUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANT ABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Site will be uninterrupted, error-free, or free of viruses or other harmful components

  • Product descriptions or other content are accurate, complete, or current

  • The results of using the Site or purchasing products will meet your expectations

Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you.

15. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, KINDRED FINE, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR SERVICE INTERRUPTION — ARISING FROM OR RELATED TO YOUR USE OF THE SITE, OUR PRODUCTS, OR THESE TERMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO KINDRED FINE IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100.

Some jurisdictions do not allow limitations on liability for certain types of damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

16. Indemnification

You agree to indemnify, defend, and hold harmless Kindred Fine LLC, and its officers, directors, employees, agents, successors, and assigns from and against any claims, liabilities, damages, losses, and expenses — including reasonable attorneys' fees — arising out of or in any way related to:

  • Your use of the Site or our products

  • Your violation of these Terms

  • Your violation of any third-party right, including intellectual property or privacy rights

  • Any User Content you submit

17 . Governing Law

These Terms and any dispute or claim arising out of or related to them or your use of the Site shall be governed by and construed in accordance with the laws of the State of New York, United States, without giving effect to any conflict of law principles.

18. Dispute Resolution

We hope to resolve any issues informally. Before filing a formal claim, please contact us at hello@kindredfine.com so we can try to resolve your concern directly.

If a dispute cannot be resolved informally, you agree that any legal action or proceeding arising out of or related to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in New York County, New York. You hereby submit to the personal jurisdiction of such courts and waive any objection to the convenience or propriety of such venue.

Jury Trial Waiver: To the fullest extent permitted by law, you and Kindred Fine each waive the right to a jury trial in any action relating to these Terms or the Site.

19. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated by updating the "Last Updated" date at the top of this page and, where appropriate, by notifying you by email. Your continued use of the Site after changes take effect constitutes your acceptance of the revised Terms.

20. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, or severed from these Terms if modification is not possible. The remaining provisions will continue in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy and Shipping & Returns policy, constitute the entire agreement between you and Kindred Fine regarding your use of the Site and supersede all prior agreements, understandings, and representations.
